Exemptions for the Turkish Work Permit Criteris of 500,000TL Paid-in Capital and 5 Turkish Employees

If a foreigner stayed in Turkey for more than 3 years with a residence permit, that foreigner will be exempt from the Turkish Work Permit criteria. Normally, the criteria to get Turkish work permit are 500,000 Turkish Lira and employing 5 Turkish citizens for each foreigner.

In evaluating work permit applications made on behalf of foreigners who have legally resided in Turkey for at least three years within the last five years from the date of Turkish work permit application (excluding student residency) under a residence permit, work permit, or international protection agreement, the employment and financial sufficiency criteria shall not be applied, limited to a maximum of three such foreigners. This means that a foreigner with 3 years residency in Turkey can apply to work permit without 500,000TL paid-in capital and 5 Turkish employees.

It is essential that the number of foreigners working with work permits in workplaces does not exceed the number of Turkish citizens working in the same workplace.

Without prejudice to the relevant legislation concerning foreigners under international protection, if more than three foreigners meeting the conditions in the first paragraph are to work at the same workplace, the evaluation of Turkish work permit applications made on behalf of the fourth and subsequent foreigners to be employed at the workplace shall be based on the employment of five Turkish citizens and the fulfillment of financial sufficiency criteria separately for each foreigner working at the workplace.

The following foreign nationals are exempt from the application of employment, financial sufficiency, and wage criteria in the evaluation of work permit applications:

a) Foreign nationals whose mother, father, or child is a Turkish citizen.

b) Foreign nationals who have been granted a humanitarian residence permit.

c) Foreign nationals who have been granted a residence permit as victims of human trafficking or who benefit from the victim support program in accordance with the Regulation on Combating Human Trafficking and Protecting Victims.

d) Foreign nationals holding a Stateless Person Identity Document.

e) Foreign nationals who have been granted a long-term residence permit.

f) Foreign nationals who have lived in marriage with a Turkish citizen for at least three years.

g) Foreign nationals who have resided in Turkey for at least eight years with a work permit, short-term residence permit, family residence permit, long-term residence permit, humanitarian residence permit, or human trafficking victim residence permit.

h) Foreign nationals who will work in professions and jobs other than those reserved for Turkish citizens, and who are declared to be of Turkish descent by the Ministry of Interior or the Ministry of Foreign Affairs, or who are deemed suitable by the General Directorate within the scope of international labor force policy.

i) Citizens of the Turkish Republic of Northern Cyprus.
